user for the use of Application “PHOTO REMINDER PLUS” and website
WWW.PHOTOREMINDERPLUS.COM which are developed by SHREEKUNJ SOFTECH
offering
reminder, diverse features and functionalities, essentially combining multiple photo apps into
one.
SHREEKUNJ SOFTECH may modify this Agreement from time to time and each modification
will be effective when it is posted on the Website. You agree to be bound to any changes to
this Agreement through your continued use of the PHOTO REMINDER PLUS
Services. You will
not be notified of any modifications to this Agreement so it is important that you review this
Agreement regularly to ensure you are updated as to any changes. If you do not agree with
any part of these terms, kindly restrain yourself from using this application.
PHOTO REMINDER PLUS in connection with any of the services those
(collectively the
“Services “) is governed by these terms & Conditions (the ‘Terms’)
● Application: Applications means the software program provided by SHREEKUNJ SOFTECH
refer to as “PHOTO REMINDER PLUS”; downloaded on any electronic device can be accessed
through or downloaded from App store and our website.
● Account: The user signs up and creates a unique account to access our services for
subscribed plan.
● Company: For the purposes of these Terms, “we”, “our”, “us”, and SHREEKUNJ SOFTECH,
providers and operators of the Services.
● Personal Data: any information that directly, indirectly, or in connection with other
information — including a personal identification number — allows for the identification or
identity of a natural person.
● You: A person or entity that is registered with “PHOTO REMINDER PLUS” for using the
Services (referred as “user”, “consumer”).
● Third-party service: Refers to advertisers, contest sponsors, promotional and marketing
partners, payment gateways and other who provide our content or whose products or
services we think may interest you.
The Photo reminder Plus application offers a wide array of diverse features and functionalities, essentially combining multiple applications into one platform. It boasts a userfriendly interface, making it incredibly simple to navigate via multiple modes. Furthermore, it provides expansive range of reminder options like text, audio, picture image etc. You can set a reminder by using a Picture Reminder, Photo Memo, Voice Tag, Text Memo & Location Memo. These reminders can be used as Photo & Document Folder Management, Reminder Management, Critical work Reminder, Important document Storage, Invitation Card Reminder, Meeting Reminder, Office Reminder, Tax Reminder, Renewals Reminder, Conference Reminder, Maintenance Reminder etc., ensuring that you never have to overlook your appointment, events, payment or medication schedules. The app’s timely notification provides guarantee that you will stay top of your commitments effectively. Photo Reminder Plus is the most easy and practical application for Time Management. Photo Reminder Plus application is highly beneficial for individuals across all age groups, ranging from students, working professionals, retirees, senior citizens, home makers, and everyone else. This revolutionary application helps you to manage your time, stay organized and live stress free. Photo Reminder Plus has introduced an innovative concept for safeguarding your data through organizing them in a system of distinctive folders and sub folders. In addition to the convenient preloaded folders, you can also have the freedom to generate new once according to your specific needs.
LICENSE: Subject to your compliance with the terms; Photo Reminder Plus grants you a limited non-exclusive, non-sub licensable, revocable, and non-transferable license to; (i) Access and use the in connection with your use of the Services; and (ii) Access and use any content information and related materials that may be made available through the Services, expressly granted herein are reserved by Photo Reminder Plus and Photo Reminder Plus’s licensors.
RESTRICTIONS: You may not; (i) remove any copyright, trademark or other proprietary notices from any portion of the Services; (ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by Urban Company; (iii) decompile, reverse engineer or disassemble the Services except as may be permitted by applicable law; (iv) link to, mirror or frame any portion of the Services; (V) cause or launch any programs or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services; or (vi) attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks. (vii) Using the Application for any illegal or unauthorized purpose. (viii) Distribute or share content i.e., harmful, obscene, offensive or violates any individuals’ fundamental rights.
• User Account: There is a process to become a user that is developed
for the convenience
and privacy of the users so that they can sign up and out efficiently. When User first visits
the application, User can register through their basic details like Full name, contact number
and email id. The sign up the application is through an OTP sent on the mobile. The user of
the application can discover the several options provided to them and choose the kind of
service they require from the application.
• Types of Reminders:
• Uploads: The user can create various folder and sub folder in the
application and organize
the data so that becomes easier for the user to set reminders in created folder. The
application has a pre created folder and sub folders for the user to make the usage easy
i.e., Birthday, Anniversary, Family, Office, Health, Insurance, Payment and above all user
can create new folders and sub folder as per requirement.
• List of views: The application provides user general calendar view
and list view with
features like a day view, weekly view, monthly view. The user can set
various filter to derive information form the application as per the user requirement.
• Sharing: The user can share their reminder to another person using
the same application.
The shared reminder can be an individual reminder or folder or sub folder reminder to
another user. The data can be shared to another subscribed user and the subscribed user
can access the shared data.
• Different modes: The application has developed to give its user
various different modes
that it provides features like left-handed mode for the lefty person.
• Storage: The application provides upto 5 Gb data cloud storage in
various subscription plans to users.
The stored data of jpeg format in the clouds is compressed before storing to attain maximum benefits.
• Accessibility: The application is accessible in on various platforms
like IOS
devices and website. The user data is synchronized across all the devices.
• Security: The user can set a pin or set a face or finger lock to
access the application to
secure the application and its data.
• Editing: The user can add, delete, move, create reminder files as
per the user’s
requirements.
To attain maxim utilization of the application and its services a user may need to register yourself on the
Application to avail the services as a subscribed user. The User can enjoy access to all app features during
the 7 – days free trial period. Following the trial period The user while using the application can
subscribe from different plans ranging from 30 days, 180 months or 360 days. Therefore, providing 30 days
cycle in each of these subscription plans will be subject to different limitations and restrictions and the
cost of each of these Subscription plans may vary. The subscription amount will be auto debited on the
renewal date by selected payment method depending on the plan user has opted i.e. Monthly, half yearly and
yearly basis. User can unsubscribe the service any time before the renewal date. We may revise subscription
plan from time to time and the same would be informed to the user before charging the revised amount. PHOTO
REMINDER PLUS may suspend or terminate their services if the subscription charges become past due date.
All the user be informed that if the subscription period has ended or
the user terminates the
subscription to any plan, their data uploaded during that duration will not be lost and it will
be available for the user to view and take backup of it. After subscription period is completed,
the user can only be able to access a new text reminder and all the other feature of the
application will be available only after resubscribing. Please be informed that once the user
deletes the account from the application then the data will be erased and removed
permanently. The user is advised to take a backup before the subscription period ends or
before deleting the account as the user won’t be able to get the same data or content.
All payments in respect of the Application Services shall be made to SHREEKUNJ SOFTECH
through the Apple app store. If you register to any of our recurring
payment plans, you agree to pay all fees or charges to your account for the Service in
accordance with the fees, charges and billing terms in effect at the time that each fee or
charge is due and payable.
Payment Options: SHREEKUNJ SOFTECH only supports in app purchases via
Apple app store. By providing us with your payment information, you agree that we
are authorized to verify information immediately and subsequently invoice your account for
all fees and charges due and payable to us hereunder and that no additional notice or consent
is required. We will be using third party payment gateways to process and facilitate the
payment of Your Subscription Fee to SHREEKUNJ SOFTECH.
Add on: The additional amount is chargeable as per the add on
subscribed by the user. The subscribed user can anytime upgrade to premium plans anytime over their period.
(i) Application and/or any facilities made available on the Application, in whole or partially,
may not be available from time to time for any reason including, without limitation, upgrading
of the Application/technology, introduction of new product(s), computer resource repairs
and application maintenance, etc.
(ii) In no event shall Application be liable for any direct, indirect, punitive, incidental, special,
consequential damages or any other damages resulting from;
(iii) Interruptions in the application shall not serve as a basis to terminate your subscription, or demand in full or partial refund of any payment made or any reductions in future payments to be made.
PHOTO REMINDER PLUS, its consultants, contracted parties, technology partners make no
representations or warranties about the accuracy, reliability, suitability, timeliness, up-gradation and/or
wholeness, of any content, graphics, images, information, software, text,
audio, video, links or communications provided on or through the use of the application or
that the operation of the application will be error free. While PHOTO REMINDER PLUS uses
reasonable efforts to keep the application accessible and error free, but PHOTO REMINDER
PLUS cannot guarantee the same.
Changes are periodically made to the application, products and to the
price/information/contents of the application. PHOTO REMINDER PLUS and/or its respective
suppliers may make improvements and/or changes in the application, products at any time
without any prior intimation or any liability to anyone.
When user upload content and information to the Site or in connection with the Services (Content"), including photo, medical reports, bills, invitation cards or other information you are undertaking, you represent and warrant to us that (1) user own or have the necessary rights to use and upload the Content, (2) the Uploading of the Content does not violate any rights of any person or entity. (3) the uploaded content is not used for any illegal activities and unauthorized purpose by the user. The user acknowledges that the application has full right to remove or restrict the data so uploaded.
Subscribed user can cancel the subscription of our services as and when required. The subscribed user may not be eligible for any refund as the payment once made will not be refunded under any circumstances. PHOTO REMINDER PLUS will be unable to process any transfer request of any subscription plan. Application provides user an option to upgrade their current plan anytime during their subscription duration up to highest subscription plan available.
PHOTO REMINDER PLUS invites you to provide your feedbacks, suggestions, convey ideas and
other submissions (collectively “Views”) on the application or by letters or e-mails as long as
the same is not violating any moral rights according to the Indian laws and is in accordance
with these Terms.
For avoidance of doubt, Views on the content of the application, products, etc. are individual
opinions of the users based on their knowledge or experience. Thus, these Views are personal
opinion. PHOTO REMINDER PLUS neither subscribes to them nor does PHOTO REMINDER
PLUS assume any responsibility or liability for the same.
If you provide Views which violate any moral rights according to the Indian laws or are
contrary to these Terms, PHOTO REMINDER PLUS, without any liability or prior intimation,
reserves the right (but not an obligation) to remove, delete, edit or refuse to retain on
application any such View that in the sole judgment of PHOTO REMINDER PLUS violates these
Terms or any Indian laws. PHOTO REMINDER PLUS may, if deemed fit, even suspend your
access or deny you an access to the application.
PHOTO REMINDER PLUS may display, include, or grant access of third-party content (such as
data, information, and other products and services), as well as give links to Third- Party
Services. PHOTO REMINDER PLUS shall not be liable for any Third-Party Services, including their
accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality,
or any other aspect thereof. Users acknowledge and agree that PHOTO REMINDER PLUS has
no control over any content offered on Third Party Services, does not monitor such Third-Party
Services, and shall in no manner be deemed to be liable or responsible to any person for such
Third-Party Services, or any content, products or services made available thereof.
NETWORK OPERATORS: The usage of the Application Service may involve
the use of third-party
telecommunications carriers and service providers (such as the services of the carrier that
provides cell phone service to you). These carriers and service providers are not our
contractors, and any information collected by a carrier in connection with your use of the
Service provided through the Application is not considered "Personal Information" and is not
covered by this Terms & Conditions. SHREEKUNJ SOFTECH is not liable for telecommunications
carriers or service provider’s acts or omissions.
The failure of PHOTO REMINDER PLUS to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.
In no event shall any subsidiary, affiliate, director, officer, employee, owner, or operator of PHOTO REMINDER PLUS be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit damages arising from your use of the services, even if PHOTO REMINDER PLUS has been advised of the possibility of such damages notwithstanding anything to the contrary contained herein, PHOTO REMINDER PLUS liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid by you to SHREEKUNJ SOFTECH for the PHOTO REMINDER PLUS services during the term of your use. The foregoing limitation of liability shall Apply to the fullest extent permitted by law in the Applicable jurisdiction. You specifically acknowledge that PHOTO REMINDER PLUS shall not be liable for user content or for any defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.
PHOTO REMINDER PLUS makes no representations about the results to be obtained from using the App. The use of same is at your own risk. The services and the content provided on the Application are on "As is" basis. PHOTO REMINDER PLUS assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any User communication or any Content. PHOTO REMINDER PLUS is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, mobile and computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or on any of the PHOTO REMINDER PLUS Services or combination thereof, including any injury or damage to users or to any person’s mobile related to or resulting from participation or downloading materials in connection with the PHOTO REMINDER PLUS Services. PHOTO REMINDER PLUS works on only cloud storage where it does not provide a backup service and user agree that you will not rely on the services for the purpose of content backup. We will not share personal information with third parties without your permission. While we make every effort to protect the personal information of the User on this App, we do not accept any liability for the security of the information. PHOTO REMINDER PLUS shall not be liable for any loss or damage that may occur while you are using the App. PHOTO REMINDER PLUS strives to protect the User Information, although we cannot ensure the security of Information furnished/transmitted by the users to us.
Users agree, confirm and acknowledge that we may modify, suspend, disrupt or discontinue the App, any part of the Application or the use of the App, whether to all users or to you specifically, at any time with or without notice to user only if it’s against the law. Users agree and acknowledge that we will not be liable for any of the aforementioned actions or for any losses or damages that are caused by end of the subscription and over uploading data for storage more than 1 GB. For the removal of any doubt, we may terminate or prevent your use of the Application and any services provided by through the Application at our sole discretion that are caused by above mentioned reason at any period of time. SHREEKUNJ SOFTECH reserve the right to close your account if it contains false, misleading or inappropriate information.
User shall indemnify and hold harmless PHOTO REMINDER PLUS, its subsidiaries, associates, consultants, contracted parties, etc., and their respective officers, directors, agents and employees, from any liability, claim or demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of your breach of these Terms or any policy/document incorporated by reference or your violation of any laws, rules, regulations or the rights of a third party.
PHOTO REMINDER PLUS and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by us, its licensors or other providers of such material and are protected by and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. The material may not be copied, modified, reproduced, downloaded or distributed in any way, in whole or in part, without the express prior written permission of us, unless and except as is expressly provided in these Terms & Conditions. Any unauthorized use of the material is prohibited.
By accessing this Application, these terms and conditions consummated between you and PHOTO REMINDER PLUS, and our relationship with you is governed by the laws of India, in the event of any dispute arising in relation to these Terms and Conditions, or any dispute arising in relation to the PHOTO REMINDER PLUS Platform, the proceeding shall be conducted in court or arbitration procedure. The Jurisdiction of the courts for the said Contract is located at Ahmedabad, Gujarat where the Arbitration proceeding shall be conducted at Indian Council of Arbitration, New Delhi for all such dispute resolution. Judgment upon any arbitral award rendered hereunder may be entered in any court, and/or Application may be made to any such court for a judicial acceptance of the award and/or an order of enforcement, as the case may be.
In the case of notices and other communications expressly permitted to be given by telephone,
all notices and other communications provided for herein shall be in writing and shall be
delivered by hand or courier service or through registered post, mailed by certified or
registered mail or sent by telecopy, as follows:

If for any reason a court of competent jurisdiction finds any provision or portion of
these Terms
& Conditions to be unenforceable, the remainder of these Terms & Conditions will continue in
full force and effect. Headings for any section of the Agreement are for reference purposes
only and in no way define, limit, construe or describe the scope or extent of such section.
PHOTO REMINDER PLUS shall have the right to assign its obligations and duties in this
Agreement and in any other agreement relating PHOTO REMINDER PLUS Services to any person
or entity. If any provision of this Agreement is held to be invalid or unenforceable, such
provision shall be struck out and the remaining provisions of the Agreement shall be enforced.
